Online Photo-Session Contract
Please take a few minutes to read the following form and fill out this online photo-session contract as we cannot proceed with any services until it is filled out and electronically signed. Thank you.
Agreement Overview
This agreement contains the entire understanding between SSP and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, signed by all initial parties. The party against whom a waiver is sought to be effective must have signed a waiver in writing.
I understand that my package, chosen from SSP's website, or custom built by the SSP team, contains only the number of images specified below. These images are edited and turned in to me up to three weeks post my image selection with print rights. I understand that I will not receive or own rights to the entire gallery taken and shown to me at the time of selection. I understand that I am able to purchase more images post my session to add to my original package.
Booking & Cancellation
Your full invoice is due at the time of booking to secure your session date. 50% of your session cost(s) is considered your non-refundable deposit. However, in case of unplanned events or emergencies, we can hold your deposit for up to 90 days where it will go towards the balance of a new scheduled session.
Contract Breeching
Any attempt to remove our logo from the pre-processed look book gallery or the final digital gallery will result in termination of our agreement to continue working with the client agreeing upon this contract. Consequences will follow and our team has the right to take legal action. At the point of breaching of contract, our team will refund the remaining balance after the non-refundable booking deposit.
Privacy
Use of Photographs: This agreement allows SSP the right to upload and publicly share any of the photographs and video footage (both live and not) taken during the session on our various social media platforms, website, and with vendors. You may opt out of this by adding the privacy feature to your session. Please notify our team you would like to be a private client and thus NOT giving SSP permission to use any photographs and video taken during the session for commercial and marketing use and want to keep your images private from the public eye. This privacy addition to your session is a $99 fee that is added to your package. If privacy is not requested and paid for in your invoice, our team assumes permission to use any and all images and video taken during your session publicly.
COVID-19 Clause
(1) Should you or a household member contract the COVID-19 virus prior to your scheduled session, we ask that the session be postponed or cancelled indefinitely. In this situation, you, the client, would be eligible to receive a full refund of your deposit and/or full balance. (2) Similarly, if someone on our team should become ill, we retain the right to cancel the scheduled session and issue a full refund without penalty. (3) Additionally, any 2021 sessions that should need to be postponed due to indirect or adverse effects of C19, Soul Sisters Photography is able to hold your deposit for up to 18 months from the date of your original scheduled session to be used at a later time (on any quantifiable session of choice.) (4) Lastly, should the client or anyone present at the session location contract the COVID-19 virus due to exposure, our studio and it's members will not be held liable under the court of law.
